These Terms of Service (“Terms”) govern your use of Freshly Kept, provided by Sooner Tech LLC dba Freshly Kept (“we”, “us”, “our”), at freshlykept.app and app.freshlykept.app (the “Service”). By creating an account or using the Service you agree to these Terms.
Eligibility and accounts
You must be at least 13 years old (16 in the EEA/UK) to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized use.
Subscription and billing
Freshly Kept is a subscription service that begins with a 7-day free trial. After the trial, your subscription automatically renews at the plan price you selected (currently Founding Monthly at $4.99/month or Founding Annual at $39.99/year) until canceled.
You can cancel at any time from the Settings screen in the app or by emailing hello@freshlykept.app. Cancellation takes effect at the end of the current billing period; you retain access until then. All payments are processed by Stripe. Fees are non-refundable except where required by law.
We may change prices with at least 30 days’ notice; changes apply to subsequent billing cycles and you may cancel before they take effect.

You agree not to:
Use the Service for unlawful purposes or in violation of these Terms.
Upload content you do not have the right to upload, or content that is abusive, harassing, or infringing.
Attempt to reverse engineer, scrape, overload, or gain unauthorized access to the Service.
Use the Service to build a competing product or to resell it to third parties.
Misuse our AI features to attempt to extract model weights, prompts, or training data.
Your content
You retain ownership of the photos and data you upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process Your Content solely to provide and improve the Service. This license ends when you delete the content or close your account, except for backups retained as described in the Privacy Policy.
Our content
The Service, including the app, website, design, code, and our trademarks, is owned by Sooner Tech LLC and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes consistent with these Terms.
AI features and food safety
The Service uses AI (including Anthropic’s Claude) to analyze photos, estimate expiration dates, and suggest recipes. AI output can be incorrect. You are solely responsible for food safety decisions. Always use your own judgment about whether food is safe to consume. Do not rely on the Service for medical, dietary, or allergen-related advice.
Service availability and changes
We aim to keep the Service available but do not guarantee uptime. We may modify, suspend, or discontinue features with reasonable notice. If we discontinue the entire Service, we will provide a pro-rated refund of any prepaid subscription fees for the remaining period.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a security risk. On termination, your right to use the Service ends immediately.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOONER TECH LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.
Indemnification
You agree to indemnify and hold harmless Sooner Tech LLC and its officers, employees, and agents from any claims arising from your use of the Service, your content, or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Oklahoma, USA, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to personal jurisdiction there.
Changes to these Terms
We may update these Terms. Material changes will be announced by email or an in-app notice at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
